LGCY Employee and Contractor Privacy Notice
This Employee and Contractor Privacy Notice (“Notice”) describes how LGCY Power, LLC (“LGCY,” “we,” or “us”) collects and uses Personal Information about you in connection with applying for an employment or contactor relationship with us and during and after your employment or contractor relationship. This Notice also addresses personal information we collect from and about beneficiaries of current and former employees.
Some jurisdictions have different or specific legal requirements governing the use of Personal Information including Personal Information of job applicants, employees, independent contractors, beneficiaries, and dependents. Where local laws require additional or different protections than as provided in this Notice, we will comply with all such laws and regulations.
INFORMATION WE COLLECT
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal Information does not include data where your identity has been removed so that we can no longer identify you by the data or associate the data with you (“anonymous data”). We may use anonymous data for any purpose without restriction.
The types of Personal Information we may collect about you and other individuals such as your dependents include:
- Personal identifiers such as name, social security number, taxpayer identification number, driver’s license number, passport number, date of birth, information technology usernames and passwords;
- Contact information such as email address, mailing address, phone number, emergency contact information;
- Financial information such as bank account number for direct deposit, the existence of garnishment or levies on wages, deductions, withholdings;
- Benefits information such as insurance and other benefits selected, enrollment information, beneficiary and dependent personal information;
- Educational information such as educational institutions attended, degrees received, educational transcripts;
- Geolocation data such as your physical location when using company-owned or authorized devices or vehicles;
- Professional/employment information such as employers, positions held, tenure, references, skill assessments, performance appraisals, training documentation, professional association memberships, background check history and results;
- Characteristics of protected classifications such as gender, age, marital status, disability, nationality, citizenship status;
- Health information such as medical reports, illness excuse notes, disability accommodation requests, drug test history and results;
- Audio/visual information such as call recordings, recordings from security cameras on work premises, photos (we will not use your photograph to create a biometric template or as biometric identifier);
- Internet and other similar network activity such as browsing history, search history, interactions with our job postings and systems, and information related to your use of company-owned or authorized devices, systems, or networks including the content of communications sent or received using such devices, systems, or networks; and
- Interferences drawn from the above categories of Personal Information that relate to your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
The types of Personal Information we collect about you may vary based on your relationship with us.
HOW WE COLLECT INFORMATION
Voluntary Disclosure
We may ask you to provide us with Personal Information when you communicate with us (online or offline), when you apply to a position or apply for a promotion, when you become an employee/contractor, when you access employee benefits, and at other times. We may also collect information you make publicly available through public forums, online accounts, and social media platforms.
Third-Party Data Sources
We may collect Personal Information from third-party data sources such as employee benefit providers, medical professionals, former employers, or service providers hired to provide identity verification services or conduct background checks, drug screenings, or credit checks.
Use of Company Equipment and Systems
If you use equipment or systems provided by us, we may collect information about your use of such equipment or systems such as the content of emails, communications through project management software, and system usage data. You understand that you have no expectation of privacy when using company-owned or authorized equipment or systems.
HOW WE USE AND SHARE YOUR INFORMATION
Generally
We use Personal Information for the following purposes:

- Benefits administration;
- Business management and planning;
- Processing employee work-related claims (for example, insurance claims);
- Accounting and auditing;
- Conducting performance reviews and determining performance requirements;
- Managing our relationship with you;
- Assessing qualifications for a particular job or task;
- Gathering evidence for disciplinary action or termination;
- Complying with applicable laws, regulations, and corporate governance requirements;
- Education, training, and development requirements;
- Maintaining commercial insurance policies and coverages;
- Performing business analytics and benchmarking;
- Complying with health and safety obligations;
- Preventing fraud;
- Facilitating network and information security, including preventing unauthorized access to our computer and electronic communications systems, preventing malicious software distribution, and other threats to our network and information security;
- Promoting physical security of our personnel, offices, devices, and equipment;
- Evaluating or facilitating business transactions such as a merger, acquisition, or asset
Service Providers
We may use third-party service providers to process Personal Information in connection with any of the above purposes. We may share any of the categories of Personal Information we collect with one or more of our service providers.
Sale of Personal Information
We do not sell the Personal Information of job applicants, employees, contractors or their emergency contacts, dependents, or beneficiaries to any third parties.
